Terms and Conditions

The SkillStamp platform (www.skillstamp.eu, including the portfolio pages under skillstamp.eu) is provided by SkillStamp UG (haftungsbeschränkt), Landstraße 17-19, 60325 Frankfurt am Main, Germany, registered in the commercial register of the Amtsgericht Frankfurt am Main under HRB 141806 ("SkillStamp", "we").

These terms apply to all users: talents (individuals who create a profile and get verified or apply for jobs) and employers (companies and their staff who post jobs and contact talents). Users' own terms do not apply, even if we do not expressly object to them.

Separate written agreements may also apply to employers, in particular about the success fee. These take precedence over these terms.

You need an account to use SkillStamp. Talents must be individuals with full legal capacity. Employers must be businesses within the meaning of § 14 BGB and act on behalf of their company; anyone creating an employer account confirms they are authorised to do so.

Completing registration creates a free user agreement. There is no right to be registered.

Each person may only have one account. Keep your login details secret. If you suspect misuse of your account, please tell us immediately.

On SkillStamp, talents can, free of charge:

• create and maintain a profile, including by uploading a CV,
• get a public portfolio page at their own address,
• browse jobs and apply to any posted job, whether or not they are verified,
• complete the five-step verification (§ 4), which is free during launch,
• receive and reply to messages and invitations from employers.

Verification has five steps: skills test, work-style and personality questionnaire, review of evidence, video and final interview. A profile counts as verified once our team has approved all five steps. Verification is valid for 12 months from completion.

We do not owe any particular result. Verification reflects a professional assessment at the time of review. It is not a promise that you will get a job.

Only verified talents are included in matching and suggested to employers.

While verification is offered free of charge, it costs you nothing. If we introduce a fee in future, we will tell you in advance. You would then only pay if you expressly order the paid service.

Employers can, free of charge, create a company profile, post jobs (including with the help of our AI assistant), get suggestions of matching verified talents, receive applications, and write to talents and invite them to jobs through the platform.

A fee only arises if an employer hires a talent they found or contacted through SkillStamp (success fee). The amount, due date and details are set out in a separate agreement between SkillStamp and the employer.

Employers report such a hire to us. The details of reporting are set out in the separate agreement.

We match verified talents with jobs, supported by a rule-based procedure and AI models. A person on our team reviews and approves every AI-assisted shortlist before the employer sees it. Employers see match tiers and explanations, not raw percentages.

Whether an employer contacts or hires a talent is decided by the employer alone. We do not owe a placement or a hire. An employment relationship is formed only between employer and talent; SkillStamp does not become a party to it.

All users agree in particular:

• to provide only true, current and their own information, including about education, work experience and evidence,
• to complete tests and questionnaires themselves and without unauthorised help, i.e. without other people and without unauthorised aids or AI tools, and not to share test content,
• not to upload forged documents or documents belonging to others,
• to use messages only for recruitment, not to send advertising or spam and not to harass anyone,
• as an employer, not to discriminate on grounds of race or ethnic origin, sex, religion or belief, disability, age or sexual identity (AGG, German General Equal Treatment Act) and to write job ads free of discrimination,
• to use other users' data only for the hiring process concerned and to comply with data protection law,
• not to scrape the platform, overload it or bypass security measures,
• not to post content that infringes third-party rights or the law.

If these terms are violated, we may remove content, revoke test results or a verification, suspend the account temporarily or terminate the user agreement. We take the user's legitimate interests and the severity of the violation into account. As a rule, we hear the user first and give reasons for our decision.

Content you post (e.g. profile details, photo, CV, video, evidence, job ads, messages) remains yours.

You grant us a simple, non-transferable right, limited to the lifetime of your account, to store this content, process it technically (e.g. translate or format it) and display it within the platform: talent profiles to employers in matching, applications and messages, and publicly on your portfolio page. We may show job ads to talents and publicly.

This right ends when you delete the content or your account, subject to statutory retention duties and the deletion periods for backups.

You confirm that you hold the necessary rights to your content.

We aim for the platform to be available without interruption, but we do not guarantee it. Maintenance, security updates and disruptions outside our control may limit use temporarily. We keep developing the platform and may change features where this is reasonable for users and the core of the free services is preserved.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have given.

For slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely.

Otherwise, liability for slight negligence is excluded.

These limitations also apply in favour of our legal representatives, employees and vicarious agents.

We are not responsible for the accuracy of other users' information or for decisions made by employers or talents.

The user agreement runs for an indefinite period. You can end it at any time without notice by deleting your account in your settings or writing to us.

We can terminate the user agreement with two weeks' notice. The right to terminate without notice for good cause, in particular for serious or repeated violations of § 7, remains unaffected.

After termination we delete your data as described in our privacy policy. Separate agreements with employers, e.g. about a success fee that has already arisen, remain unaffected.

SkillStamp's services are currently free of charge for consumers. If we offer consumers paid services in future, they will receive separate withdrawal information (Widerrufsbelehrung) before ordering. The statutory right of withdrawal remains unaffected.

We may change these terms for a valid reason, in particular new features or changes in law or case law. We will tell you about changes by email at least six weeks before they take effect. If you do not object within this period, the changes are deemed accepted; we will point this out separately in the notice. If you object, either side may terminate the user agreement as of the date the changes take effect. Changes to the main obligations or the introduction of fees require your express consent.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country where they have their habitual residence.

If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is Frankfurt am Main.

If any provision of these terms is invalid, the remaining provisions remain valid. The statutory provisions replace the invalid provision.
